We don't know that for sure. They keep mentioning a "strategy element," which unfortunately sounds more like simple base management than something a la X-Com. From the videos, it seems a lot more tactical than just some corny shooter. There hasn't been a lot of media surrounding the game, and a good deal of info hasn't been posted on the site. Right now there's no telling which direction it's learning towards.

As for the producers of Red Dawn suing the makers of the game...I kind of doubt it. John Milius has gotten way too fat -- he and Lucas trade chocolate chip cookie recipes if the rumors are true -- to be bothered with getting out of his massively reinforced office chair and waddling/slithering into a court.
