Looks like they have aquired it, according to NMA...
For those of you who remember mr Brian Fargo, the old president of Black Isle, will be glad to hear that his new company called InXile have bought the rights to Wasteland (the game Fallout is based on). So it looks like good old Fargo will develop both Bards Tale and Wasteland, some good old games.

probably not alot, considering that anyone at interplay or its subsidiaries that worked on wasteland has already been fired.

I believe that it is still somehow attached to that company for a set amount of time (years). Then after said amount of time expires, it becomes public domain.
