Not necessarily, country law totally overrules them petty terms of uses. Thus, if copyright or "cracking" laws are non-existent in a given country or if it's just allowed, those silly terms of use are useless.Kharn wrote:It is if the crack violates the Terms of Use. Sure, but sadly this is the internets, and we're under US law here, boyoh, don't matter that them crazy Rooskies don't care about no copyright laws.Thor Kaufman wrote:Not necessarily, country law totally overrules them petty terms of uses. It's an odd country that allows that, too. Terms of Use are a binding contract, contracts generally aren't quickly overruled by law unless they break them (not unless the law fails to enforce them).
But hey, nobody loves finding holes in the law as pirates do

No. Anything shipped out of a country loses that country's jurisdiction, hence you apply the laws of the country in which the terms are broken. In this case, it would be the U.K. In the U.K. no court will enforce those standard Terms of Service. Courts in the U.K. ignore pretty much most standard contract forms and adopt the objective approach, what were the parties thinking and intending to do at the time of formation of contract. Since there was no financial loss suffered by either party, there is no way that a U.K. court would ever enforce something as petty and silly as cracking a game.Kharn wrote:Sure, but sadly this is the internets, and we're under US law here, boyoh, don't matter that them crazy Rooskies don't care about no copyright laws.Thor Kaufman wrote:Not necessarily, country law totally overrules them petty terms of uses. I love finding holes indeed. :way of the pirate:
Also I don't care what the companies want, I care for me. They have to deliver a good product under my (or more generally) the customer's conditions. There is no excuse for silly copy protections in my books. The time I own something I want to deal with it how I want and want to do so conveniently. If that means warranty void or whatever, alright, but don't force shit on me.
Also, the term copyright is a bit misleading, we are not talking using other people's inventions for commercial use here, that's an entirely different matter.
