best update is on the gamasutra website. Gamasutra noted that in the court filings it was stated that Bethesda and Interplay made a confidential agreement that ended the preliminary injunction, which suggested a final deal had been made. However, turns out that the deal that was struck didn't end the whole case, just some parts of it, most notably the preliminary injunction.
gamasutra notes that Interplay made some pretty provocative/aggressive comments in their SEC filing about the case. Bethesda's comments, through Pete Hines, are much more subdued.

No. Gamasutra states, quite correctly, that the language of the court filing might indicate a confidential agreement. It does not state it outright, nor does Gamasutra claim it does. Most of us didn't leap to such conclusions. Some of us did. Brother None
so glad the superior intellect of Brother None was here to save the day. He, would of course, never jump to conclusions or even slightly misinterpret early information that is out there. his intellect far surpasses those who were first to the news, such as Frymuchan, who read into some of the early information that was out there.
Makes me wish I knew Brother None in real life... He seems like such a cool guy and most importantly, such a nice, down to earth, nonpretentious fellow. Brilliant, so kind is in his demeanor, and from all accounts, quite a looker, ladies man, philanthropist, and independently wealthy gentleman. He is above all of the lower, uninformed, less intelligent droves that populate this planet, but we are lucky that once in awhile he swoops in, passes around his brilliance and insight, and then again ascends into the heavens with his fellow angels. Three cheers for Brother None!!

Wow, Brother None's powers of insight and brilliance continue to astound me. Who, other than someone of his intellectual stature, could discover my true identity. I'm still in amazement, astounded as ever with his astuteness, attention to detail, and all around affability/good guyedness.
